On September 12, the Association of Ukrainian Banks (AUB) held a professional webinar on the topic “How to Detect and Record Procedural Errors of the Investigation Team During a Search in a Financial Institution.” The event brought together executives, top managers, lawyers, and security specialists. The discussion focused not only on identifying common procedural mistakes during searches, but also on staff response algorithms, the role of the attorney, and court practice regarding the recognition of evidence as inadmissible.
Participants noted the high level of expertise of the speaker — Denys Ovcharov, President of SB-CLUB and Head of the Business Protection Practice at the law firm ADER HABER. His practical recommendations sparked a lively discussion and became a valuable tool for developing effective business protection strategies.
Today, the issue of timely detection and documentation of procedural errors during searches in financial institutions is extremely important. Legal practice shows that investigators and prosecutors still make a number of violations, such as the absence of an attorney or witnesses, inaccuracies in protocols, or incorrect details in court orders. Such mistakes can lead to the recognition of evidence as inadmissible and result in significant reputational losses. Moreover, in the context of unstable court practice and frequent legislative changes, companies need clear action algorithms for adequate responses to investigative actions.
An untimely or incorrect reaction may have far-reaching consequences: property seizure, business interruptions, violation of clients’ rights, lawsuits, and loss of trust. That is why knowledge of legal protection mechanisms is the key to stability and trust in the financial sector. This topic is especially relevant given Ukraine’s growing focus on transparency, human rights compliance, as well as combating corruption and money laundering — where procedural legality is a key element of effectiveness.
