Results of the Association of Ukrainian Banks for May 2024

The Association of Ukrainian Banks (AUB) has summarised its activities for May 2024, focusing on important initiatives and events aimed at developing and protecting the interests of the financial sector of Ukraine.

Issues of the banking sector

  • The AUB submitted proposals to the relevant committee of the Verkhovna Rada of Ukraine on the Draft Law of Ukraine ‘On Amendments to Certain Legislative Acts of Ukraine on Improving the Efficiency of Management of Problem Debts of State-Owned Banks’.
  • The Association submitted proposals to the National Bank of Ukraine on the draft Law of Ukraine No. 11220 dated 29.04.2024 ‘On Amendments to the Civil Code of Ukraine on the Settlement of Certain Issues of Refusal to Accept Inheritance by the Heir in the Event of Creditors’ Claims for the Testator's Obligations’.
  • The AUB submitted proposals to the Ministry of Defence of Ukraine on the draft Procedure for the performance of military transport duty.
  • The Association sent proposals to the Ministry of Economy of Ukraine on the draft Procedure for the performance of military transport duty.
  • The AUB has processed a response from the National Bank of Ukraine regarding the reservation of funds on the correspondent account with the National Bank of Ukraine for funds in foreign currency.
  • The Association sent a request to the National Bank of Ukraine to provide the regulator's recommendations on the application of certain requirements of Resolution of the Cabinet of Ministers of Ukraine No. 28 ‘On Providing Financial State Support’ dated 24 January 2020 and Resolution of the Board of the National Bank of Ukraine No. 23 ‘On Certain Issues of Activities of Ukrainian Banks and Banking Groups’ dated 25 February 2022.
  • The AUB submitted proposals to the National Bank of Ukraine to amend the Regulation on the Procedure for Determining the Amount of Regulatory Capital by Ukrainian Banks.
  • The Association sent a letter to the National Bank of Ukraine to form a common position of the banking community and discuss practical issues of filling in the data of the standard audit file (SAF-T UA).

Questions of non-bank financial institutions

  • The Association has processed the response from the National Bank of Ukraine regarding the use of facial recognition in the process of customer due diligence.
  • The Association sent a request to the National Bank of Ukraine to obtain clarification on the practical application of the definition of the category of consumers entitled to receive benefits.
  • The Association sent a request to the National Bank of Ukraine to obtain clarification on the application of certain provisions of the Law of Ukraine ‘On Social and Legal Protection of Military Personnel and Members of Their Families’.
  • The Association sent a request to the National Bank of Ukraine to obtain clarification on the application of the requirements of the Ukrainian legislation on financial monitoring in terms of loan repayment.
  • The Association sent a request to the National Bank of Ukraine to obtain clarifications on the practical application of certain requirements for financial monitoring in terms of financial monitoring using an individual's ID card.
  • The Association sent proposals to the relevant committee of the Verkhovna Rada to amend the provisions of the Civil Code of Ukraine in terms of determining the right of a minor to independently conclude a payment account agreement and dispose of funds on a payment account.
  • The Association sent a request to the National Bank of Ukraine to discuss the Concept of Reforming Factoring Regulation in Ukraine.
  • The Association sent a request to the National Bank of Ukraine to provide clarifications on the practical aspects of implementing financial monitoring legislation in terms of working with PEPs.
  • The Association sent a request to the National Bank of Ukraine for clarification on the application of the requirements of Resolution of the Board of the National Bank of Ukraine No. 37 dated 04.04.2024 ‘On Amendments to Certain Regulatory Acts of the National Bank of Ukraine on Supervision’.
  • The Association has processed the response from the National Bank of Ukraine on outsourcing issues.

Participation in thematic events

  • On 03 May, a meeting of the Board of the Association of Ukrainian Banks was held.
  • On 14 May, under the media partnership of the Association of Ukrainian Banks, a screening of the documentary Da Vinci was held in Ivano-Frankivsk.
  • On 15 May, under the media partnership of the Association of Ukrainian Banks, a screening of the documentary ‘Da Vinci’ was held in Lviv.
  • On 16 May, a meeting of the UBA Committee on Non-Bank Lending was held on the topic: ‘Discussion of issues related to outsourcing in accordance with the Law of Ukraine “On Financial Services and Financial Companies”’.
  • On 16 May, under the information partnership of the Association of Ukrainian Banks, Crowe Mikhailenko, an audit company, held a webinar for banks on tax issues: https://www.youtube.com/watch?v=O3j6apuWcqw
  • On 20 May, a meeting of the AUB Committee on Banking Supervision was held on the topic: ‘Consideration and discussion of proposals for amendments to Resolution of the Board of the National Bank of Ukraine No. 23 dated 25 February 2022 and Resolution of the Board of the National Bank of Ukraine No. 196 dated 28 December 2023’.
  • On 23 May, a Memorandum of Understanding and Cooperation was signed between the Association of Ukrainian Banks and the Ministry of Social Policy, which will help further promote the development of the project to improve the mechanism for providing administrative services to Ukrainians with the active involvement of Ukrainian banks.
  • On 24 May, the Association took part in the forum: ‘Youth - the basis of human capital and the restoration of Ukraine’.
  • On 29 May, the Association, together with representatives of banks, held a working meeting on problematic issues in working with bank guarantees for participation in the ProZorro tender.
  • May 30 The President and Vice-Presidents of the Association of Ukrainian Banks personally recognised Kharkiv bank branches of the Power Banking network for their selfless work and resilience during the war.
  • On 30 May, under the media partnership of the Association of Ukrainian Banks, the documentary film Da Vinci was screened in Kharkiv.
  • On 31 May, under the media partnership of the Association of Ukrainian Banks, the XII Forum of Cash Circulation UKRAINIAN CASH FORUM-2024 was held.
