Нова влада, попри правільні заяви і обіцянки на Майдані, на практиці починає процес згортання розвитку громадянського суспільства в Україні, – вважає Президент Асоціації українських банків Олександр Сугоняко. Одним із прикладів такої тривожної тенденції він назвав останню нараду Юлії Тимошенко з керівниками окремих банків, яка відбулась  нещодавно.

За його словами, обговорення системних проблем, питань змін до законодавства щодо діяльності банків має відбуватись не лише з представниками окремих фінансових груп чи банків, але з системою в цілому, інтереси якої якраз покликана відстоювати Асоціація українських банків як професійне і недержавне об”єднання, до якого входить більшість діючих в Україні комерційних банків.

Банкіри стурбовані, оскільки навіть за старої влади подібні питання вдавалося худо-бідно узгоджувати з усією системою. Згадана ж нарада, вважають в АУБ, проведена кулуарно, у вузькому колі окремих банків, багато з яких залежні від Уряду. До того ж – без узгодження і участі Асоціації, хоча саме АУБ у зверненнях до Прем”єр-міністра раніше обґрунтовувала необхідність її скликання. “Це свідчить про те, що при вирішенні принципових питань розвитку банківської системи Уряд збирається враховувати інтереси лише окремих фінансових груп, а не банківського співтовариства в цілому”, – каже Олександр Сугоняко.

Щодо заяв Юлії Тимошенко про низьке податкове навантаження на українські банки, то Президент АУБ підкреслив, що мінімізація податків – не є злочин ані за європейським, ані за українським законодавством. Це треба знати.

Бажання ж запровадити індикативне оподаткування доходів банків, про що заявила Прем”єр-міністр, є неприпустимим – вважають в АУБ, адже це може призвести до суттєвих бюджетних збитків. Це поставить банки в нерівні конкурентні умови. Податкове навантаження має бути однакове для всіх, а податкове законодавство – прозоре, зрозуміле і спрощене.

До того ж, відповідно до Закону України “Про систему оподаткування” зміни до податкового законодавства не можуть запроваджуватись раніше ніж за шість місяців до початку нового бюджетного року.

За словами Президента АУБ, порушують Конституцію України і узагальнені заяви щодо ухилення банків від оподаткування без доведення таких обвинувачень в суді. Статтею 62 Конституції України передбачено, що особа вважається невинною, доки її вину не буде доведено в законному порядку і встановлено обвинувальним вироком суду. Якщо в Уряду є претензії до якогось окремого банку, то їх мають доводити в суді, а не виносити на широкий загал, до того ж узагальнюючи і перекладаючи на всю банківську систему. Такі дії є непрофесійні, підривають ділову репутацію банків як інститутів громадської довіри і несуть в собі загрозу як для банківської системи, так і для економіки України, – зазначає Олександр Сугоняко.

Професійні учасники фінансового ринку неодноразово демонстрували свою відкритість і готовність до співпраці з Урядом. Для цього була створена Координаційна рада професійних об”єднань учасників фінансового ринку. Проте останні дії влади свідчать, що у неї дещо інше бачення співпраці з елементами громадянського суспільства.

“Віктор Ющенко, Юлія Тимошенко, інші лідери помаранчевої революції увесь час запевняли, що їх метою є формуванні в Україні громадянського суспільства, важлива роль у чому має належати неурядовим організаціям. Проте на практиці Уряд демонструє ігнорування і зневагу до неурядових професійних об”єднань, що загрожує поверненням до тоталітарних принципів управління в державі. Такі дії Уряду є небезпечними і помилковими”, – вважає Президент АУБ. На його переконання, необхідно від передвиборних обіцянок і декларацій переходити до реальної реалізації програми побудови громадянського суспільства та залучення до цього процесу неурядового сектору.

На переконання Асоціації українських банків, першочергову увагу треба спрямовувати не на створення додаткових фіскальних навантажень, а на забезпечення сприятливих умов розвитку банківської системи на її капіталізацію. Подібні ж дії Уряду – стратегічна помилка, - переконані в АУБ.

New government inspite of right statements and promises in the Maidan begins a practical process of slowdown of civil society development in Ukraine, President of the Association of Ukrainian Banks Olexandr Sugonyako considers. He called the latest meeting of Yuliya Tymoshenko with the bank executives an example of such anxious tendency.

According to him, discussion of the system problems, issues on amendments to the legislation on banking activity has to be held not only with the representatives of certain financial groups or banks but also with the system on the whole the interests of which the Association of Ukrainian Banks being a professional and non-governmental association comprising a majority of present commercial banks in Ukraine is authorized to protect.

The bankers are concerned because even in the times of the old government it was possible to settle such issues anyhow. The mentioned meeting, the AUB considers, was held behind the scenes, with the participation of a certain number of banks the most of which depend on the government. In addition, without coordination and participation of the Association though it was the AUB that proved the necessity of its calling in the appeals to the Prime minister earlier. "It shows that while solving the principal problems of the banking system development the Government is going to respect the interests only of separate financial groups but not the association on the whole", Olexandr Sugonyako says.

On the statements of Yuliya Tymoshenko on the low taxation of  Ukrainian banks the President of the AUB underlined that a tax mitigation is not crime both according to the European and Ukrainian legislation. It is necessary to know.

A proposition of the Prime Minister to initiate an indicative income taxation of banks is inadmissible, the AUB considers, because it can cause great budget losses. It will put banks into unequal competitive conditions. Taxation has to be equal for everybody and tax legislation should be transparent, understandable, and simplified.

Besides, according to the Law of Ukraine "On taxation system" amendments to the tax legislation cannot be made earlier than six months before new budget year.

According to the President of the AUB, the generalized claims on the bank tax evasion without proving such charges in court violate the Constitution of Ukraine. Article 62 of the Constitution of Ukraine envisages that a person is considered to be unguilty until his/her guilt will be proved legally and found by court verdict of guilty. If the government has claims to any bank they should be represented in the court but not in public generalizing and transfering into the whole banking system. Such actions are unprofessional and they tainted the  business reputation of banks as institutions of public credit and constitute a menace both for banking system and economy of Ukraine," Olexandr Sugonyako said.

Professional participants of the financial market many times demonstrated their openness and readiness to cooperate with the Government. For this purpose a Coordinating Council of professional associations of financial market members. However, the latest actions of the government show that it has a little different vision of cooperation with civil society elements.

"Viktor Yushchenko, Yuliya tymoshenko, other leaders of the Orange revolution constantly assured that their aim was a formation of the civil society in Ukraine. The important role has to be assigned to the non-governmental organizations. However, in practice the Government demonstrates its neglect and disregard to the non-governmental professional associations and this can cause the return to the totalitarian principles of a state government. Such actions of the Government are dangerous and wrong", the President of the AUB considers. He is sure that it is necessary to change pre-election pledges and declarations into real implementation of a program of civil society creation and involvement of a non-governmental sector to this process.

The AUB is sure that first of all the attention should be paid not to the creation of additional fiscal liabilities but to the creation of favourable conditions for banking system development, for its capitalization. Similar actions of the Government is a strategic mistake, the AUB said.
