On May, 31, 2005 in the Verkhovna Rada of Ukraine (VRU) the draft law On amendments to the Law of Ukraine On banks and banking (security of the banks property and their clients), registration number 3223 (hereunder referred to the draft law 3223) was defeated.
The draft law empowered banks to use firearms for the security of money, currency values which are saved directly in bank buildings as well as during the collection and delivery.
Till now there is no civilized market of the armed security services in Ukraine and the predominant position in this sphere is occupied by one structure the State Security Service (SSS) under the auspices of the Ministry of Internal Affairs of Ukraine (MIA). Since only the SSS has a right to use firearms in the banking institutions security it takes advantage of such position in its own favor. For the last 4 years the SSS presses on banks concerning the increase in the cost of their services. And not only on banks.
The President of the Association of Ukrainian Banks considers that the evident example of business growth is the current status of the SSS of the MIA of Ukraine. Since 2001 the Association of Ukrainian Banks (AUB) has been supporting the competitive base formation in the security services market taking into consideration the European experience of our neighbors.
The bankers concern in security field was shared by the members of the security market the Ukrainian Federation of Non-governmental Security Services Workers as well as the peoples deputies of Ukraine. In 2004 the Constitution statement On recognition of paragraph 9 of Provision on the State Security Service of the Ministry of Foreign Affairs approved by the Edict of the Cabinet of Ministers of Ukraine 615 of 10.08.1993 to be unconstitutional was submitted to the Constitutional Court of Ukraine under the signatures of 50 peoples deputies of Ukraine. The substance of the statement is in ascertaining:Is a SSS militiaman a civil servant or an entrepreneur?
It is important that the third signature in the Constitutional statement is a signature of Minister of Internal Affairs Yuriy Lutsenko.
In the time of the previous government on March, 18 2004 a democratic draft law of the NBU 3223 was approved by 277 peoples deputies in the first reading.
Under the current government the draft law was approved only by 131 deputies.
It was not sustained by communists, faction of the National Party and socialists.
Besides, 35% deputies of Nasha Ukraina, 68% of BYUT (Block of Yuliya Timoshenko), 71% of Party of Industrialists and Entrepreneurs of Ukraine. The democrats have very flexible position. The actions of Regiony and SDPU(o) that did not vote almost  by the whole are quite understandable.
The acts of the deputies of the group Democratic Ukraine which approved the draft law by the whole and the faction of the Ukrainian National Party in which only three deputies did not vote inspire the respect. It is a service for principles and introduction of European values while forming the security services market.
On the whole, the voting in the Parliament demonstrates the power of the post-authoritarian machinery and political immaturity of our democrats. Lets be attentive!
